On January 27th, 2026, Spain announced significant new legislation that would grant residency and the right to work to more than half a million undocumented immigrants currently living in the country. The announcement was made against a backdrop of heated immigration politics in the United States, and Spanish politicians did not shy away from making that connection explicit, publicly condemning what they called racist ICE raids that systematically violate human rights.
What We Know So Far
The official legal text has not been published yet, so the full details of the application process are still unclear. But here is what has been confirmed: to qualify, you must have been living in Spain for at least five months as of December 31st, 2025. The application window is expected to be very short, opening in early April 2026 and closing at the end of June 2026. It Is Not Just for Undocumented Immigrants
This is an important point that many people may overlook. You do not have to have entered Spain without documentation to potentially qualify. If you entered legally but have since fallen out of compliance with your original visa, you may also be eligible. That could include a digital nomad whose client terminated their contract, or a language assistant who overstayed their student visa after the program ended. The scope of this measure appears to be broader than the headline suggests.
